BREEDING CONTRACT

SALES CONTRACT
In as much as Jennifer Smith, hereafter called the "Breeder”, offer for sale a Breeding quality Labrador retriever:

Hereafter called the "buyers", agree to purchase the Labrador retriever under the following warranties and conditions. NO OTHER WARRANTIES OR CONDITIONS ARE EITHER EXPRESSED OR IMPLIED.
This contract is being freely entered into by both parties, without any mental reservations whatsoever.
Breeder agrees that the above described dog is a purebred Labrador retriever, with AKC registered parents. Buyer shall duly register this dog with AKC using the Stillwater prefix in the registered name.
Breeder agrees this dog is in good health at the time of purchase and will furnish buyer with the puppy’s immunization records . Buyer agrees to have the puppy examined by a licensed veterinarian, within 48 hours of the effective date of this contract. Buyer may waive the vet check if desired, but is fully responsible after pickup of the puppy. Buyer shall assume full responsibility for the above described puppy during the following said 48 hour period. If the puppy is found to be unhealthy during said 48 hours, then the buyer may return the puppy and all relating paperwork and will receive a replacement puppy of equal value. Breeder will require a letter from the veterinarian stating the nature of the health problem.
Breeder offers no explicit guarantees against hip dysplasia in the above described Labrador retriever; however, should this dog become disabled by hip dysplasia before the age of two years due to a genetic defect in the hip, breeder will replace the dog with one of equal value. Breeder will have the right to have puppy x-rayed by a veterinarian of her choice for a second opinion at his or her expense. This guarantee does not cover trauma related or environmental factors that have affected the dogs hips adversely.
In the event that the above said dog becomes blind in either or both eyes from a genetic defect, the breeder will replace the dog with one of equal value. The genetic defect must be professionally diagnosed by a veterinarian, and a written record must be produced by the buyer. This guarantee does not cover trauma related or environmental factors that have affected the dogs eyes adversely. If the dog is breed before two years of age this contract is no longer in effect

The buyer further agrees to take the following steps regarding health, safety and training of the dog described herein:

Buyer agrees to properly maintain the health of the dog, for the life of the dog, which includes regular exercise and proper diet, to annually have the dog examined by a licensed veterinarian to determine fitness of the dog, and to have the dog annually vaccinated and maintained on a heartworm preventative.
The buyers shall provide a FENCED yard, proper shelter, adequate feeding and exercise.
The animal shall be properly socialized by judicious exposure to other people outside the family, children, other dogs, strange places, sights and sounds, beginning immediately after protective immunization.

Should the buyer of the above described animal not meet the conditions set forth in sections A-C the breeder shall have the right to repossess the animal with no compensation to the buyer. The breeder will follow whatever legal means necessary to regain animal.

Buyer agrees to release and hold harmless Breeder for any and all liability, damages or injuries caused either directly or indirectly by the Labrador Retriever to any person, whether actual or legal, or to any property , whether real or personal. Furthermore, buyer assumes full liability for any damages or injuries, whether physical, mental, emotional or economic, caused by the Labrador retriever dog to any person, whether real or personal, after receiving and acknowledging delivery and possession of said dog. Buyer further agrees to indemnify or reimburse Breeder as a result of any costs or expenses incurred by the Breeder as a result of any act of Buyer causing liability damages or injuries as set forth herein. Breeder is not responsible for any future medical bills for said dog NO refunds on purchase price, replacement of puppy only. The buyer agrees that should it become necessary to dispose of the animal described herein by sale or any other means of change of ownership, the breeder will be given
FIRST RIGHT OF REFUSAL at original purchase price. Buyer has read and understands the
FIRST RIGHT OF REFUSAL or optional agreement attached hereto.
All legal questions or disputes regarding this contract will be governed by the laws of the state of Montana, venue Flathead County. If any term, provision, condition or covenant of this contract , should for any reason, be held illegal, invalid, void or unenforceable, the remainder of this contract shall remain in full force and effect. As long as said breeder is breeding Labrador Retrivers
BUYER ACKNOWLEDGES READING AND UNDERSTANDING EACH OF THE ABOVE LISTED CONDITIONS.

We the undersigned have read this contract and so understand and agree to its terms and conditions. The written terms of this contract constitute the entire agreement between buyer and breeder and no other written, verbal or implied statements, promises, documents, or writings shall not have any effect on this contract. Contract is vaild upon final payment.
